A Drug Test Result Is Not the End of a Claim

    by Franks, Koenig & NeuweltOct 19, 2026

A drug or alcohol test after a workplace accident can change how a claim is handled overnight. Florida’s workers’ compensation statute includes a rule that bars benefits in certain impairment cases, and it adds a presumption that places a heavy burden on the injured worker. Reading the actual text shows where the rule stops.

The Statute Bars Benefits Only in Defined Situations

Under section 440.09(3) of the Florida Statutes, compensation is not payable if the injury was occasioned primarily by the employee’s intoxication, by the influence of drugs not prescribed by a physician, or by the willful intention to injure or kill. The word primarily carries weight, because impairment that played a minor part in an accident does not meet that standard on its face.

For that reason, a Wellington workplace injury lawyer starts with the accident itself: what the worker was doing, what equipment or conditions were involved, and whether anything other than impairment explains the injury. In Wellington those conditions range from warehouses and landscaping crews to equestrian facilities, medical offices, and construction sites along State Road 7.

A Positive Test Creates a Presumption

Subsection (7) lays out how testing works. An employer that suspects impairment played a primary role may require the injured employee to be tested. A blood alcohol level at or above the limit in section 316.193, or a positive drug confirmation, creates a presumption that the injury was occasioned primarily by the intoxication or drug influence.

Several features of that presumption matter:

    • With a qualifying drug-testing program under sections 440.101 and 440.102, it can be rebutted only by evidence that there is no reasonable hypothesis that impairment contributed to the injury.
    • Without one, it can be rebutted by clear and convincing evidence.
    • A refusal to submit to testing creates a presumption of drug influence unless clear and convincing evidence points the other way.
    • The presumption does not apply if the employer had actual knowledge of the impairment and expressly acquiesced in the employee’s presence at work.

    Rebuttal Takes Specific Proof

To rebut the presumption, the injured worker must prove the actual quantitative amounts of the drug or its metabolites shown in the initial and confirmation tests, and must offer evidence beyond a simple denial that drugs played a role. The statute also says a urine test cannot be rejected solely because urine is a bodily fluid.

That standard is demanding, which makes the testing paperwork important, and the statute requires positive specimens to be kept for at least 90 days. A worker who receives a denial based on a test should keep every document the employer or carrier provides.

    Denials Can Be Challenged

A denial that relies on impairment is one of several reasons a carrier may reject a claim. The firm’s discussion of why claims are denied notes that intoxication or drug use can be raised alongside disputes about whether the injury happened on the job, missed deadlines, and preexisting conditions.

Timing also shapes the response. A worker who learns of a denial should review claim deadlines right away, since, as that article explains, Florida sets a 30-day notice rule and a two-year filing period.

Local facts matter too. Someone hurt in Wellington and told that a test result ends the claim may want to read about a Wellington denied workers’ compensation claim lawyer before accepting that outcome, because a denial is a starting position and not a final ruling.

    Representation Limited to Injured Workers

On who the firm represents, the Law Offices of Franks, Koenig & Neuwelt says it does not take cases for employers or insurance carriers and handles every workplace injury case on a contingency basis. That focus means the work centers on reading statutes such as section 440.09 from the injured worker’s side.

Causation also looks different depending on the job. A machinery or equipment injury, the kind a Wellington industrial accident lawyer handles, often leaves physical evidence that explains the accident apart from any test result.

    Gather the Paperwork Early

Test results, the employer’s written testing policy if one exists, and the denial letter are the documents that decide whether the presumption can be challenged. Anyone facing a denial tied to a drug or alcohol test can reach out to a Wellington workplace injury lawyer with those papers so the presumption and the proof needed to rebut it can be reviewed together.
